RTSWS Career Center – Terms of Use

1. Introduction and Important Notice

Thank you for visiting and using the RTSWS Career Center (“Site”). The Site and its related services (“Services”) enable users to connect with peers, mentors, alumni, and professionals within a trusted environment. The Services are provided by Rock The Street, Wall Street (“RTSWS”).

By using the Services, you agree to these Terms of Use (“Terms”). Please read them carefully.

These Terms may be updated periodically. Continued use of the Services constitutes acceptance of any changes.

2. Definitions and Interpretations

For the purposes of these Terms:

“Site” refers to this website and any webpage derived from it that provides the Services.
“Personal Data” has the meaning defined under the UK Data Protection Act 2018 and the EU GDPR.
“Us,” “we,” or “our” refers to Rock The Street, Wall Street (RTSWS).
“You” refers to the user or visitor of the RTSWS Career Center.

3. Access to the Services

To access the Services, you must:

Provide your own internet access and pay all related fees.
Supply the equipment necessary to connect online.
Ensure your use complies with all applicable laws and regulations.

You represent that you:

Meet the minimum age requirement (16 in the Netherlands; 14 in the US, Canada, Germany, Spain, Australia; 13 elsewhere—or older if required by local law).
Are not restricted or prohibited from having an account.
Are not a competitor of RTSWS and will not use the Services for competitive purposes.
Will only maintain one account.
Will use your real name and accurate information.
Have authority to enter into this Agreement.
Will not violate any rights of RTSWS or third parties.

Your access may be denied at any time at RTSWS’s discretion.

4. Registration

Registration is required to use the Services. You agree to:

Provide accurate, current information.
Update your information when needed.

Registration may occur through “Connect with LinkedIn,” “Connect with Facebook,” or by email. By registering, you authorize RTSWS to:

Access your designated LinkedIn or Facebook profile information according to their terms and privacy policies.
Store relevant profile information (“Stored Information”).
Display Stored Information to other platform users when you choose to share it.
Provide Stored Information internally within RTSWS for contact, engagement, and development purposes.

RTSWS will use Stored Information solely to provide and improve the Services and for RTSWS’s nonprofit purposes as described in these Terms and applicable privacy notices.

5. Use of the Site

The Services allow you to:

Share personal, professional, and educational details.
Connect and network with others.
Engage with RTSWS updates, opportunities, and events.
Share content, opportunities, and media with the community.

You retain ownership of the content you submit. You may request deletion; however, RTSWS cannot control copies made by other users.

By posting content, you grant RTSWS a nonexclusive, worldwide, transferable, sub-licensable, royalty-free license to use that content to provide, promote, and improve the Services and RTSWS’s nonprofit mission. This license continues for content that has been shared or copied by others even if you later delete it from your profile.

You agree not to:

Share your password or account access with others.
Restrict or inhibit others’ use of the Services.
Post unlawful, defamatory, obscene, hateful, harassing, or otherwise objectionable content.
Post advertisements, spam, pyramid schemes, or unsolicited promotions, except as expressly permitted.
Upload viruses, malware, or any harmful code.
Copy, reproduce, distribute, or commercially exploit Site content or software without express written permission.

RTSWS may delete accounts impersonating others or violating these Terms. RTSWS may remove or edit content at its sole discretion.

6. Services Content

RTSWS may monitor the Services as needed and disclose information to:

Comply with laws or legal processes.
Operate and protect the Site and Services.
Safeguard RTSWS, its users, and its partners.

Private messages will not be intentionally monitored unless required by law.

Personal Data is governed by RTSWS’s applicable privacy policies and notices.

RTSWS may modify, enhance, or discontinue features of the Services at any time.

Information on the Site may at times be incomplete, inaccurate, or outdated. RTSWS is not obligated to correct such information.

7. Warranties

The Services are provided “as is” and “as available” without warranties of any kind. RTSWS does not warrant that:

The Services will meet your needs.
The Services will be error-free, secure, or uninterrupted.
Content will be accurate, reliable, or complete.
The Site will be free of viruses or harmful components.

You assume full responsibility for how you use any information obtained through the Services.

8. Liability

To the fullest extent permitted by law:

RTSWS disclaims all liability for damages arising from your use of or inability to use the Services.
RTSWS is not responsible for loss of data, interruptions, errors, unauthorized access, or security incidents arising from factors beyond its reasonable control.
RTSWS is not responsible for content posted by third parties or other users.
RTSWS is not responsible for misuse of ideas or information that you share through the Services.
You are solely responsible for your interactions with other users.

Nothing in these Terms limits RTSWS’s liability for fraud or death/personal injury caused by negligence where such limitation would be unlawful.

9. Indemnification

You agree to defend, indemnify, and hold RTSWS and its affiliates harmless against all claims, damages, costs, and losses (including reasonable attorneys’ fees) arising from:

Your violation of these Terms.
Content you submit or share.
Activities you conduct via or in connection with the Services.

10. Copyright, Trademarks, and Intellectual Property

All copyrights and trademarks appearing on the Site belong to their respective owners.

You may not copy, modify, distribute, publish, or exploit any Materials or content from the Site or Services without prior written permission from RTSWS or the relevant rights holder.

11. Third Party Links

The Site and/or Services may include links or references to third-party websites or applications. These are provided for your convenience only.

RTSWS does not control and is not responsible for third-party sites, content, products, or services. Inclusion of such links does not constitute endorsement.

You should review the terms and privacy policies of any third-party site or application before using it or sharing information with it.

Some functionality within the Services may be powered by third parties such as YouTube (a Google company) and is also governed by the terms and privacy policies of those providers.

You use third-party sites and applications at your own risk.

12. Transactions

If you make purchases, donations, or other transactions through or linked from the Site, you must provide accurate and current information (including payment details).

RTSWS is not liable for disputes, losses, or damages arising from your dealings with merchants or service providers.

You are responsible for taxes and charges related to your transactions.

13. Online Advertising

If you post or sponsor any form of advertising, job posting, or promotional content through the Services, you are responsible for ensuring compliance with all applicable laws (including nondiscrimination and employment laws where applicable).

RTSWS may remove any advertisement or posting that it considers inappropriate, discriminatory, misleading, or damaging to RTSWS’s reputation, without refund.

You agree to deal fairly and professionally with individuals who respond to your advertisements or postings and to indemnify RTSWS from claims arising out of your postings or conduct.

14. Waiver

If RTSWS does not enforce any right or provision of these Terms, that does not constitute a waiver of such right or provision.

No waiver is effective unless it is in writing and clearly identified as a waiver of a specific provision.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent as closely as possible.

16. Law and Jurisdiction

These Terms are governed by US law. Any dispute or claim arising out of or in connection with the Site or the Services shall be subject to the exclusive jurisdiction of the US court.

17. Communications

We may provide service messages, notices, or updates through email, in-account notifications, banners, or other electronic means. You agree to receive these communications as part of the Services.

You are responsible for maintaining accurate contact information within your account.

The Services may include third-party advertising, for which RTSWS is not responsible.

Electronic communications from RTSWS (including via the Site) satisfy any legal requirement that such communications be in writing, to the extent permitted by law.

18. Photo and Media Release

By attending or participating in any program, event, or activity affiliated with RTSWS, students and their guardians acknowledge and agree that RTSWS may capture photographs, video recordings, and other media featuring participants. These materials may be used for program documentation, promotional purposes, and other nonprofit-related communications, in print or digital form. Participation in affiliated events constitutes consent to such use unless a written request to opt out is submitted to RTSWS in advance.

19. Notices

All legal notices given by you to RTSWS must be sent to:

RTSWS may give notice to you at the email or postal address associated with your account. Notices are deemed received:

Immediately when posted on the Site.
24 hours after an email is sent.
Three days after the date of posting of any physical letter.

To show that a notice has been given, it is sufficient to show, in the case of a letter, that it was properly addressed, stamped, and placed in the post, and in the case of an email, that it was sent to the specified email address of the addressee.
